Quote from fenn68 on October 20, 2020, 12:12 pmWell the winter plot thickens:
Luis Campusano has been arrested in Georgia for FELONY marijuana possession per Kevin Acee.
Don’t know the laws in Georgia ... so don’t know what constitutes a FELONY.

Quote from WindsorUK on October 20, 2020, 12:32 pmA felony? For marijuana? In 2020 America?
This should be a non story.
Luis will still be our starting catcher in 2022.

Quote from fenn68 on October 20, 2020, 12:39 pmOn Campusano he was stopped with 79 grams of marijuana. In CA that would be a misdemeanor and likely a $500 fine. In Georgia that amount is a FELONY with the potential of a 10 year prison sentence. Now almost zero chance that occurs and most likely the prosecutor settles for a plea / fine.
Not on MLB’s substance list any more so should not be an issue there ... maybe a call for counseling by the league and the Padres.
Georgia is his home state ... so probably should have knew the law and falls in the “dumb” category having that amount in his car at 5:30 in the morning. No idea why he was pulled over which precipitated the discovery.

Quote from MrPadre19 on October 20, 2020, 1:09 pmI live in Georgia but by no means an expert in its marijuana laws....but i believe anything over 1 oz. is a felony.
Not a good situation but I can't see it having any lasting consequences unless it happens again.

Quote from Brian Connelly on October 20, 2020, 2:26 pmQuote from fenn68 on October 20, 2020, 10:47 amPerdomo just had TJ surgery ... will miss all of 2021.
Was on the bubble for non-tender this winter ... bubble just burst? (Padres might sign him back on a minor league deal as he rehabs).
Also thought he would have been good enough to be a throw-in in a bigger trade deal ... not now.
Well, opens another roster slot .... Padres are heading towards being well under 40 on the roster at the start of the 2021 season.
I feel bad for Perdomo... sucks where he is at in his career. I'm actually wondering now if Pedro Avila & Miguel Diaz re-upped on TWO year Minor league deals last year? One to rehab back to full health, one to benefit the Padres org as a healthy player? But Perdomo already in arb, so not sure what they'll do with $ tight, but non-tender is 100% certain.
While the law in Georgia sounds UTTERLY INSANELY STUPID.... so is Campusano for taking that kind of risk. Everyone there's gotta at least have casual knowledge of what the laws there are about it. Pot not being legal everywhere is stupid, I don't care about that. Do care about the lack of judgement 2 guys (Pham, now Campusano) have shown already this offseason.

Quote from fenn68 on October 20, 2020, 2:41 pmNot an expert but 79 grams translates into about 250 joints .... about 0.32 grams per. That is a pretty big baggie ... and probably why part of the charge is beyond a “personal use” issue ... intent to distribute?

Quote from fenn68 on October 20, 2020, 2:50 pmLet us not forget the unfortunate Tommy Pham incident this month ... making even a more interesting off season.
Pham did not make a lot of fans with the Pacer’s patrons since ... despite the circumventing the shutdown rules by calling itself a restaurant ... apparently they still had “entertainment” violating the rules and Pham’s incident exposed that (I suspect the police knew but were really were not looking all that hard) and then the police had no choice to force a full shutdown. Ripple effect, other similar establishments in the city that have be circumventing the rules now also have been closed.
What is an athlete to do to get a good meal at 10:30 pm on a Sunday night?
Pham - Campusano - ???????

I believe there are only 8 States where Pot is legal.....So it’s pretty much the same in 42 others.

Quote from JasonE135 on October 20, 2020, 7:09 pm79 grams comes out to just under 3 ounces. That is a ton of weed! 20 years ago that much would cost $1,200 retail. Either he is selling (probably not) or he is trying to impress his friends. Either way he is a major idiot.

Quote from fenn68 on October 20, 2020, 8:19 pmThe break off point in GA between a misdemeanor and a felony is 1 oz (Campusano was 2.7 oz. I think ... so not a close call).
Have no idea how “flexible” the local prosecutor / judge can be under Georgia law but that is a big issue in this case .... more so if the prosecutor / judge are reluctant to give a break to a celebrity when cranking down on others.
My guess the first step is to put doubt on the justification of the police stop. If not justified ... the marijuana discovery is inadmissible ... case dropped.
If the bust in valid ... can a plea deal include a drop to a misdemeanor ... where the penalties is up to $1000 and up to 1 year in jail ... easily settle at the max fine and some community service. Throw-in a first offender condition (assuming it is) and after a period the crime is expunged.
BUT (and this is the real issue) IF under GA law a bust on 2.7 oz MUST be adjudicated as a felony ... the penalty moves to up to $5000 and up to 10 years in prison with the big kicker being that a one year jail term is MANDATORY. No idea on any wiggle room around that.
A game for the judicial system ... and Georgia is Georgia and can’t tell from here in CA their approach. High probability they get this swept under the rug ... void the stop / pleading it down to misdemeanor. Just don’t dismiss the small chance the prosecutor takes this all the way and then even with a minimum sentence ... one year of jail time (maybe with a quick probation release).
Not sure how MLB deals with a player with a felony conviction.
