Since they have reinstated him, I think the only they could do is DFA him, and then anyone could have him for league minimum.

I mean he is the best SP available if he gets cut... he was never convicted in court and he has served and paid dearly for his actuons... How would everyone feel about him in Padres Brown?

Basically, my uncertainty comes from a lack of evidence.  I have seen the accusations, I have seen zero evidence.  I am not sure accusations with no evidential backing should be enough to end his career

He would sue the MLB and the players Union would too.. He is not a PED 3 strike guy.. he (in the eyes of the law) is an innocent man.. He needs to be given a chance to make a living... He is also someone that marches to his own beat so hard to gage where and I he would pitch.. I think Cleveland would take him back .. he was loved there... we could certainly use him.. But what do his former teammates in Clev say about him.. is he a problem in the clubhouse? Or is he a silly Myers type goof ball to an extreme ...I cant remember these things as he has been out of sight out of mind.. 50 game suspension so like Tatis would come to ST.. then go to Minors and serve the rest of his suspension before he could be added to 40... and thus 26.... Lots of ways this could go...

If the teammate chemistry is deemed to be at least neutral and Manny meets with Siedler and AJP and says "the more the better" ..then "the more the better"...

Padres seem to be high character org.. but in this case how can you judge Bauer's charscter when in the eyes of the law he is an innocent man

Maybe we could sign DeShaun Watson too…never charged but really?

Or Tatis Jr getting injured while having sex with the same Woman that accused Bauer..

I mean Watson is back and playing.. and in his case there was evidence of sexual behavior ..and soliciting... in Bauer's case there is not...

 

Also where are all the so called Sports Journalist in San Diego... 1st thing I would do is called or email AJP and Siedler and ask a simple?.. If LAD releases Bauer is he someone you would consider adding to round out your roster? If no why? If yes, follow up with have you talked to Manny and some of the key players about their feelings towards Bauer coming to SD or if they even want him here?... Step up San Diego Sports writers/radio personalities..

It is 💯 a very polarizing argument... For sure.   I dont have a view one way or another.  I just find it weird that we judge people one way or another even if there is no evidence of wrong doing and punish someone even though (under the law) he is innocent... The MLB had it for him cause he walked to his own drum beat and called it out for various things and subjects.. before during and after these accusations .. Hey of he was guilty accused and jailed for his actions ..its black and white  no way no how... But he wasn't so back in a gray area.. I mean Hader said some racist shit that pretty bad and didn't face any punishment like this..and Zach Davies had his own sexual issues and he still P... Bauer (like him/hate him/ despite him ) did nothing wrong (black and white) in accordance to the law.. just gray and unknown to anyone but those directly involved.. sooo?? Again as I type and type .. maybe NOT for Padres is the right call for now.. but I don't believe he should be "blacklisted" from baseball.. per say...

No, Bauer did not commit a crime. He admitted that he choked the girl until she passed out then sodomized her. Totally legal if consensual, but still very unsavory. The unsavory part is the only part that any team actually cares about. Teams don't care if their players have vices, they care if they get caught. You can be abusive, a racist, a sexual deviant all you want...AS LONG AS THE FANS DON'T FIND OUT. He will not be signing with the Padres for the same reason Johnny Depp won't be doing any more Pirates movies: guilty or innocent, fair or not, he is tainted.

Isn't his accuser also the daughter of Rich Hill, the former head baseball coach at USD? That might also irk a lot of locals.

I am not going to judge someone I don't know ... I did share a video on the negative side on Bauer early on... here is one (with Clevinger working with some HS kids a while back) that is a positive one.. felt the need for the Ying and the Yang

Question do the LAD have to add Bauer to their 40 man BEFORE releasing him (if that is what they do)..and then release him..,? reason I ask if that is the case they would need to DFA 1 player from their 40..and there is a couple I like that could be DFA if this is the case..talk about a double whammy

I don't know, but either way that DFAed player would have to pass through waivers wouldn't they? I doubt they would fall to us. Who are you looking at?

I find it pretty disgusting anyone here would even entertain the idea of bringing Bauer onboard, or choose to play the role of devil's advocate or defender for the piece of sh*t that he is. The dude has been disgusting for a variety of reasons long before the awful allegations against him came to light a few years ago. He's a toxic, disgusting, pseudointellectual f*cknut who has no place in a professional clubhouse any longer. I don't want my kids to even be aware who he is, let alone ask about him or start liking him because he's wearing a professional uniform or (god forbid) brown and mustard.

LAD have until Jan 6th to decide whether to DFA him or add him to the 40 man.

I would expect him to be DFA and the LAD eat the $22.5MM owed him for the rest of the season. Keeping in mind that he was not liked before this situation going back to his UCLA times and not pitched for over a year … would be surprised any team would take him and risk creating a negative clubhouse and clearly get big negative reaction from a big portion of their fan base. Basically, the teams are not judging Bauer’s morals but judging how others will react to a Bauer’s signing and the impact on the ballclub.

Having said that, sports history proves me wrong again and again if the player is “good enough” on the field to help the team win. Deshaun Watson is this year’s prime example … not only did he get signed by the Browns when they played his first game in Houston the fan cheered. So, would not rule out a team being “interested” … but really doubt that will be the Padres given Siedler’s character.

The “legal” side of this is interesting … and MLB has said they don’t agree with the arbitrator and the suspension should have remained while Bauer’s lawyers said they don’t agree with the arbitrator and the full suspension should have been lifted and back pay been granted. (Would expect nothing less by both sides).

Good chance neither side appeals … apparently within the CBA the right to suspend for domestic abuse without the player being convicted is a negotiation clause between he League and the Union and courts have a reluctance to challenge. The arbitration did not challenge the right but the extent of the penalty.

So, essentially, MLB has a “morals clause” where they (I expect with the Union) have unilateral ability to suspend based on their criteria without the player being legally guilty. Not unheard of in a lot of companies where, as a private business they create standard to protect the business. Then the arbitrator deals with magnitude of the suspension but not the right.

Every case is different in fact so a bit hard to use precedent. Again I would not touch Bauer but his case is a challenge. LA DA would not even prosecute based on the evidence and based on some of the evidence it “appears” that beyond being consensual it was the woman who was the instigator (and had gone this route before). No idea of the truth on either side. Stepping back MLB has a lot of power to make the call based solely on their whims regardless on legal status. Side: don’t really know how MLB defines domestic abuse and their standard of evidence to initiate the suspension … apparently different than the legal system. A very slippery slope for MLB becoming the moral police (although their right).

You don’t have to agree with people on things, but you are going a bit far on your opinion of people who would entertain or even talk about the idea.

MAINLY OF DeLuca

Only players that would be DFA are 2 or 3 P with a little MLB time who have looked good if not great.... 2 of their IFers who I like.. and DeLuca (most likely to be DFA) who still only 24 and had 24-25 bombs in 23 (minors and an .888 OPS) gladly would use 1 of 3 spots left in our 40 for him
